DIGEST AND PURPOSE 

Currently,  in a municipality with a population of 1.5 million or more a
private vendor or county is prohibited from establishing a jail, detention
center, work camp or related facility within onehalf mile of a public
school, institution of higher education, or place of worship.  C.S.H.B.
681 exempts a booking facility that will be established within 500 feet of
an existing county jail or detention facility from the prohibition that a
private vendor or county not establish a jail, detention center, work camp
or related facility within one-half mile of a public school, institution
of higher education, or place of worship in a municipality with a
population of 1.5 million or more.   

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 361.067, Local Government Code, as follows:

Sec. 361.067.  LOCATION OF JAIL RESTRICTED IN POPULOUS MUNICIPALITY. (a)
Creates this subsection from existing text. 

(b) Provides that Subsection (a) does not apply to a booking facility that
will be established within 500 feet of an existing county jail or
detention facility. 

SECTION 2.  Effective date:  upon passage or September 1, 2003.
