C.S.H.B. 835 78(R) BILL ANALYSIS C.S.H.B. 835 By: Rodriguez Regulated Industries Committee Report (Substituted) BACKGROUND AND PURPOSE Currently, the board of directors of the Texas Underground Facility Notification Corporation is composed of 12 members. The Railroad Commission of Texas has oversight for certain underground facilities, but does not have representation on the board of directors. CSHB 835 would expand the membership of the board of directors of the Texas Underground Facility Notification Corporation to 13 members. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS CSHB 835 amends Section 251.055(a) of the Utilities Code, increasing the number of members on the board of directors for the Texas Underground Facility Notification Corporation to 13 from 12. The new member will be from the Railroad Commission of Texas. Section 251.056(a) of the Utilities Code is amended to allow for either 4 or 5 directors to be replaced every August 31st. EFFECTIVE DATE September 1, 2003 COMPARISON OF ORIGINAL TO SUBSTITUTE The original version of HB 835 increased the number of directors on the Texas Underground Facility Notification Corporation from 12 to 14. The two new members were to be from the Public Utility Commission of Texas and the Railroad Commission of Texas. The substituted version of HB 835 decreases the proposed number of directors from 14 to 13, removing the Public Utility Commission's representative from the board of directors.
