SRC-AMY H.B. 850 78(R) BILL ANALYSIS Senate Research Center H.B. 850 78R5026 SMH-DBy: Talton (Brimer) Business & Commerce 4/22/2003 Engrossed DIGEST AND PURPOSE Currently, all Texas vehicle dealers and converters are required to be licensed in this state. Converted vehicle dealers who are licensed to sell towable recreational vehicles, motor homes, ambulances, and fire-fighting vehicles are exempted from any additional requirements for showing or selling their products at expositions. Licensed towing converters are the only vehicle converter not exempted from the prohibition from selling their product at a show or exhibition. H.B. 850 grants tow truck converters the same exemption granted to all other converters. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2301.358(c), Occupations Code, to include a tow truck in the list of vehicles the sale of which at a show or exhibition is not prohibited by this section, if certain criteria are met. SECTION 2. Effective date: September 1, 2003.
