H.B. 850 78(R) BILL ANALYSIS H.B. 850 By: Talton Transportation Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, all Texas vehicle dealers and converters are required, in the regular course of their business, to be licensed in this state. Converted vehicle dealers who are licensed to sell towable recreational vehicles, motor homes, ambulances, and fire-fighting vehicles are exempted from any additional requirements for showing or selling their product at expositions. Licensed towing converters are the single vehicle converter not exempted from the prohibition of the sale of their product at a show or exhibition. The purpose of HB 850 is to grant tow truck converters the same exemption granted to all other converters. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS HB 850 exempts tow trucks from the requirements of Section 2301.358(c) of the Occupations Code which prohibits the sale of new motor vehicles at a show or exhibition. EFFECTIVE DATE September 1, 2003.
