SRC-VRA H.B. 889 78(R) BILL ANALYSIS Senate Research Center H.B. 889 78R993 MCK-DBy: Dutton (Lucio) Jurisprudence 4/28/2003 Engrossed DIGEST AND PURPOSE The 74th Texas Legislature amended the Family Code to prohibit the enforcement of an agreement in a suit affecting the parent-child relationship as a contract. However, in the nonsubstantive recodification of the Family Code, the provision prohibiting such an agreement as a contract was only carried forward to the code section on conservatorship and not the code section on child support. H.B. 889 conforms the code section on child support agreements to the pre-codification provisions and prohibits the enforcement of such agreements as contracts. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 154.124(c), Family Code, to provide that child support agreements are not enforceable as contracts. SECTION 2.Effective date: September 1, 2003. Makes application of this Act prospective.
