DIGEST AND PURPOSE 

Currently, the plot owners of nonprofit cemetery corporations control the
corporation.  Some non-profit cemetery corporations were not formed by
plot owners but are technically under the control of the plot owners.
H.B. 904 allows nonprofit cemetery corporations that were not formed by
plot owners to be controlled by the people who did form the corporation. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 711.023, Health and Safety Code, by adding
Subsection (c) to provide that this section does not apply to certain
nonprofit cemetery corporations formed before September 1, 1963. 

SECTION 2.  Effective date:  September 1, 2003.
