DIGEST AND PURPOSE 

Currently, a county that has surplus or salvage property may dispose of
the property in several ways. Even if a commissioners court would like to
donate the property, it must first go through a bid process at county
expense that could result in no bids.  H.B. 970 authorizes a commissioners
court to donate surplus or salvage property to a local civic or charitable
organization without having to first undertake a bid process at the
county's expense. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 263.152(a), Local Government Code, to authorize
the commissioners court of a county to dispose of surplus or salvage
property by donating the property to a civic or charitable organization
located in the county if the commissioners court determines that certain
criteria are met.  

SECTION 2.  Repealer:  Section 263.152(c), Local Government Code
(Disposition). 

SECTION 3.  Effective date:  upon passage or September 1, 2003.
