H.B. 1168 78(R) BILL ANALYSIS H.B. 1168 By: Madden Public Education Committee Report (Unamended) BACKGROUND Across Texas, many professional employees in the public school system have dual assignments, serving as classroom teachers and as athletic coaches in extracurricular activities. Section 21.353, Education Code, requires that any teacher who directs extracurricular activities in addition to performing classroom teaching duties be evaluated exclusively on classroom teaching performance. PURPOSE House Bill 1168 permits school districts to evaluate their professional employees beyond the classroom and take into consideration all aspects of his or her assignments. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1168 amends the Education Code by repealing Section 21.353 which stipulates that a teacher who directs extracurricular activities in addition to performing classroom teaching duties shall be appraised only on the basis of classroom teaching performance and not on performance in connection with extracurricular activities. EFFECTIVE DATE September 1, 2003.
