C.S.H.B. 1169 78(R) BILL ANALYSIS C.S.H.B. 1169 By: Madden Public Education Committee Report (Substituted) BACKGROUND Under current law, the commissioner of education is required to develop job descriptions and evaluation forms for counselors in consultation with the state counselors' association. The commissioner lacks similar control over the job description of other employee classifications over which the district has discretion. PURPOSE The purpose of C.S.H.B. 1169 is to place local control over a position established at the discretion of the local school district. The bill provides that a school district's use of the school counselor job description and evaluation form developed by the commissioner is optional. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. ANALYSIS C.S.H.B. 1169 amends the Education Code by requiring the commissioner of education (commissioner) to develop a job description and an evaluation form for optional use by school districts in evaluating school counselors. The bill authorizes the board of trustees of a school district to use the job description and evaluation form developed by the commissioner. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 1169 modifies the original version by reinstating the provision that requires the commissioner to consult with state guidance counselor associations in the development and modification of the job description and the evaluation form.
