DIGEST AND PURPOSE 

Currently, the State Board of Education (SBOE) may reject a textbook only
if certain criteria exists.  H.B. 1172 authorizes SBOE to set textbook
content standards and authorizes it to reject textbooks that do not meet
those standards or the requirements of the Texas Education Code. 

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the State Board of Education
in SECTION 1 (Section 31.0221, Education Code) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter B, Chapter 31, Education Code, by adding
Section 31.0221, as follows: 
 
Sec. 31.0221.  TEXTBOOK CONTENT.  (a)  Authorizes the State Board of
Education (SBOE), in addition to the procedures otherwise provided by this
subchapter, to by rule adopt general textbook content standards and
provide for a  process under which textbooks are reviewed by the board to
determine compliance with the standards and with the requirements of
Section 28.002(h). 
 
(b)  Authorizes SBOE by majority vote, notwithstanding any other provision
of this subchapter, to reject a textbook for placement on a conforming or
nonconforming list if the textbook is determined through the process
authorized by Subsection (a) to not comply with the general textbook
content standards adopted by the board under this section or the
requirements of Section 28.002(h). 
 
SECTION 2.  Effective date:  September 1, 2003.  Provides that this Act
applies to each textbook submitted for adoption in response to a
proclamation issued by SBOE on or after September 1, 2003.
