SRC-JEC H.B. 1174 78(R) BILL ANALYSIS Senate Research Center H.B. 1174 78R4519 DRH-DBy: Brown, Betty (Staples) State Affairs 5/5/2003 Engrossed DIGEST AND PURPOSE Currently, an early voting clerk must provide representation for each political party conducting a primary election in the county at each branch polling place. H.B. 1174 requires the clerk to make the representation equal. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 85.069, Election Code, by amending Subsection (b) and adding Subsection (c), as follows: (b) Includes an exception as provided by Subsection (c). (c) Requires that the composition of the set of election officers serving a branch polling place who are not employees of the county, for the general election for state and county officers and for a special election to fill a vacancy in an office regularly filled at the general election for state and county officers, to the extent practicable, provide equal representation for each political party conducting a primary election in the county. SECTION 2. Effective date: September 1, 2003.
