SRC-VRA H.B. 1186 78(R) BILL ANALYSIS Senate Research Center H.B. 1186 By: Hegar (Armbrister) Intergovernmental Relations 5/17/2003 Engrossed DIGEST AND PURPOSE Currently, the Transportation Code does not allow constables to serve as weight enforcement officers. Some counties that experience more road traffic than others may need extra weight enforcement officers to assist in the inspection of vehicles in that county. H.B. 1186 gives the county commissioners court in a county with a population of 40,000 or more the ability to designate county constables as weight enforcement officers. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 621.401, Transportation Code, to redefine "weight enforcement officer." SECTION 2. Amends Subchapter F, Chapter 621, Transportation Code, by adding Section 621.4015, as follows: Sec. 621.4015. DESIGNATION BY COMMISSIONERS COURT. Authorizes a county commissioners court of a county with a population of 40,000 or more to designate a constable or deputy constable of the county as a weight enforcement officer. SECTION 3. Effective date: upon passage or September 1, 2003.
