H.B. 1186 78(R) BILL ANALYSIS H.B. 1186 By: Hegar County Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, the Transportation Code does not allow constables to serve as weight enforcement officers. Some counties that experience more road traffic than others may need extra weight enforcement officers to assist in the inspection of vehicles in that county. This bill will give County Commissioners Courts the ability to designate County Constables as weight enforcement officers to remedy this problem. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Section 1. This amends section 621.401 of the Transportation Code to add "a constable or deputy constable designated under Section 621.4015," to the list of persons who may serve as weight enforcement officers. Section 2. This adds Section 621.4015 which authorizes a county commissioners court to designate a constable or deputy constable as a weight enforcement officer. EFFECTIVE DATE This Act takes effect immediately if it receives a vote of two-thirds of all members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
