C.S.H.B. 1230 78(R) BILL ANALYSIS C.S.H.B. 1230 By: Elkins Business & Industry Committee Report (Substituted) BACKGROUND AND PURPOSE The State Office of Risk Management (SORM) provides several functions for the State of Texas. The main function is to act as the state's workers' compensation insurance carrier. The other is to provide full risk management services to state agencies, which include health and safety training and assessments, mainly geared toward reducing workers' compensation costs for the state. Under current law, workers' compensation claims for a Community Supervision and Correction Department employee are paid by SORM. HB 1230 gives SORM the ability to provide risk management services to Community Supervision and Correction Departments as they would any other state agency. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Section 1. Amends Section 412.011, Labor Code, to require the State Office of Risk Management to provide risk management services to community supervision and correction departments. Section 2. Provides that this Act takes effect September 1, 2003. EFFECTIVE DATE September 1, 2003 COMPARISON OF ORIGINAL TO SUBSTITUTE Section 1. C.S.H.B. 1230 modifies the original bill by amending Section 412.001(b) of the Labor Code to add number 8 which will require the State Office of Risk Management to provide risk management services for employees of community supervision and corrections departments established under Chapter 76 of the Government Code. Section 2. C.S.H.B. 1230 deletes from the original bill Subsection (f) of Section 412.011 of the Labor Code. C.S.H.B. 1230 deletes from the original bill amending Section 76.006(c) of the Government Code. C.S.H.B. 1230 modifies the original bill by moving Section 3 of the original bill to Section 2 of the substitute.
