DIGEST AND PURPOSE 

Current law makes "the penetration of the anus or female sexual organ of
another person by any means" a sexual assault or aggravated assault,
depending upon other circumstances.  However, the law does not criminalize
the penetration of a male sexual organ.  H.B. 1246 provides a criminal
offense for the penetration of the sexual organ of another person, male or
female. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 22.011(a), Penal Code, to remove the word
"female" in relation to a sexual organ. 
 
SECTION 2.  Amends Section 22.021(a), Penal Code, to make conforming
changes.         
SECTION 3.  (a)  Effective date:  September 1, 2003.

            (b)  Makes application of this Act prospective.
