H.B. 1246 78(R) BILL ANALYSIS H.B. 1246 By: Riddle Criminal Jurisprudence Committee Report (Unamended) BACKGROUND AND PURPOSE Current law makes "the penetration of the anus or female sexual organ of another person by any means" a sexual assault or aggravated assault, depending upon other circumstances. However, the law does not criminalize the penetration of a male sexual organ (such as through the use of an inanimate object or other device). House Bill 1246 would make penetration of the sexual organ of another person, male or female, a criminal offense. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1246 amends the Penal Code to make non consensual penetration of the sexual organ of another person, male or female, a criminal offense. EFFECTIVE DATE September 1, 2003.
