SRC-LBB H.B. 1264 78(R) BILL ANALYSIS Senate Research Center H.B. 1264 By: Cook, Robby (Ogden) Business & Commerce 4/24/2003 Engrossed DIGEST AND PURPOSE Currently, Texas wineries are prohibited from selling wine for consumption on or off premises and dispensing free wine for consumption on or off premises unless the winery is located in specific areas. H.B. 1264 adds new locations to the list of those allowed to sell wine for consumption on or off premises and dispense free wine for consumption on or off premises. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 16.01(d), Alcoholic Beverage Code, to add to the list of locations in which the holder of a winery permit is authorized to sell wine to ultimate consumers for consumption on or off winery premises and dispense free wine for consumption on or off the winery premises. SECTION 2. Effective date: September 1, 2003.
