H.B. 1264 78(R) BILL ANALYSIS H.B. 1264 By: Cook, Robby Licensing & Administrative Procedures Committee Report (Unamended) BACKGROUND AND PURPOSE Under current law, Texas wineries are prohibited from selling wine for consumption on or off winery premises and dispensing free wine for consumption on or off the winery premises unless the winery is located in 3 distinct areas of the state, Grapevine, Galveston County or Gillespie County. This bill (HB 1264) adds Lee County to the list of locations allowed to sell wine on premises for consumption on or off premises and dispense free wine for consumption on or off the winery premises. RULEMAKING AUTHORITY This bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Amends Section 16.01(d), Alcoholic Beverage Code, by adding subsection (4) which seeks to include a county that has a population of 10,000 or more; and was created by the legislature from four or more pre-existing counties. EFFECTIVE DATE September 1, 2003.
