SRC-AMY H.B. 1296 78(R) BILL ANALYSIS Senate Research Center H.B. 1296 78R6504 RCJ-FBy: Noriega (Lindsay) Business & Commerce 5/10/2003 Engrossed DIGEST AND PURPOSE Currently, competitive bidding requirements for navigation districts and port authorities require a public notice to be published for the purchase of materials, supplies, machinery, equipment or other items that will exceed $25,000. H.B. 1296 adds the specification that the public notice indicate whether a small business development program applies to the purchase and, if so, where a copy of the program requirements may be obtained. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 60.404(d), Water Code, to include, along with other requirements, the requirement that the specifications indicate whether a small business development program adopted by the port commission of the port authority or district applies to the purchase and, if so, where to obtain a copy of the program requirements. SECTION 2. Amends Section 60.4125, Water Code, by adding Subsection (d) to require the purchase solicitation, if a purchase or contract made under Subsection (a) is subject to a small business development program adopted by the port commission of the port authority or district, to indicate that fact and to indicate where to obtain a copy of the program requirements. SECTION 3. Effective date: upon passage or September 1, 2003.
