SRC-TAG H.B. 1328 78(R) BILL ANALYSIS Senate Research Center H.B. 1328 78R1579 SGA-FBy: Phillips (Estes) Natural Resources 4/21/2003 Engrossed DIGEST AND PURPOSE In 1937, the 75th United States Congress passed Public Law No. 415 which designated the United States Secretary of Agriculture to work in cooperation with the Texas Parks and Wildlife Department on federal aid for wildlife restoration projects. In 1939, federal law was amended to transfer the responsibility of these projects from the U.S. Secretary of Agriculture to the Secretary of the Interior. In practice, the Texas Parks and Wildlife Department has already adopted this change and has worked with the U.S Secretary of the Interior; however, Section 83.003 of the Parks and Wildlife Code was never amended to reflected this change. H.B. 1328 amends the Parks and Wildlife Code to reflect the change in federal authority in regards to wildlife restoration projects from the Secretary of Agriculture to the Secretary of the Interior. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 83.003, Parks and Wildlife Code, to require the Texas Department of Parks and Wildlife to comply with the Act of the 75th Congress regarding cooperative wildliferestoration projects and rules and regulations promulgated under that act by the United States Secretary of the Interior, rather than the United States Secretary of Agriculture. SECTION 2. Effective date: upon passage or September 1, 2003.
