H.B. 1328 78(R) BILL ANALYSIS H.B. 1328 By: Phillips State Cultural and Recreational Resources Committee Report (Unamended) BACKGROUND AND PURPOSE Section 83.003 Parks and Wildlife Code deals with Public Law No. 415, 75th Congress, and Act of Congress that allows for federal aid in wildlife-restoration projects, among others. Historically, the Secretary of Agriculture was authorized and directed to cooperate with the states through their respective state fish and game departments in wildlife-restoration projects. Under the Reorganization Plan No. II of 1939, functions of the United States Secretary of Agriculture relating to conservation of wildlife, game and migratory birds were transferred to the United State Secretary of the Interior. The purpose of HB 1328 is to amend state law so as to reflect the change in federal authority with respect to wildlife restoration projects from the Secretary of Agriculture to the United States Secretary of the Interior. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS HB 1328 amends the Parks and Wildlife code to accurately reflect the change in federal authority over federal aid in wildlife-restoration projects from the United States Secretary of Agriculture to the United States Secretary of the Interior. EFFECTIVE DATE Immediately, or if the Act does not receive the necessary vote for immediate effect, the Act takes effect on September 1, 2003.
