SRC-VRA C.S.H.B. 1387 78(R)BILL ANALYSIS Senate Research CenterC.S.H.B. 1387 By: Hamric (Lindsay) Intergovernmental Relations 5/21/2003 Committee Report (Substituted) DIGEST AND PURPOSE Currently, a county has the authority to regulate on-premise signs through a permitting process but does not have the authority to collect a fee for performing this function. C.S.H.B. 1387 allows a county commissioners court, of a county regulating on premise signs to recover the costs of issuing permits for on-premise signs. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 394.063, Transportation Code, by adding Subsection (f), to authorize the commissioners court of a county regulating on-premise signs under this section to recover from an applicant for a permit authorized by this section the cost of issuing the permit. SECTION 2. Effective date: September 1, 2003. Makes application of this Act prospective.
