SRC-LBB H.B. 1439 78(R) BILL ANALYSIS Senate Research Center H.B. 1439 78R5314 JRJ-FBy: Eissler (Williams) Infrastructure Development and Security 5/9/2003 Engrossed DIGEST AND PURPOSE Currently, Chapter 1393, Acts of the 76th Legislature, Regular Session, 1999, allows the commissioners courts of certain counties to extend traffic rules that apply to county roads to the roads of a private subdivision in an unincorporated area of that county on petition of 25 percent of the property owners residing in that subdivision in which the roads are privately maintained or on the request of the governing body of the entity that maintains those roads. Subsection (a), Chapter 913, Acts of the 77th Legislature, Regular Session, 2001, raised the population of counties to which this section applies from 10,000 or less to 100,000 or less. H.B. 1439 amends Section 542.007(a), Transportation Code, to increase the population of counties to which this section applies from 100,000 or less to 500,000 or less. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 542.007(a), Transportation Code, to provide that this section applies only to a subdivision that is located in the unincorporated area of a county with a population of 500,000 or less, rather than 100,000 or less. SECTION 2. Effective date: September 1, 2003.
