SRC-TJG H.B. 1454 78(R) BILL ANALYSIS Senate Research Center H.B. 1454 By: Eiland (Janek) Intergovernmental Relations 4/17/2003 Engrossed DIGEST AND PURPOSE Currently, Section 204.002(a), Property Code, relating to powers of a property owners' association regarding restrictive covenants, only applies to a residential real estate subdivision, excluding certain condominium developments, that is located in whole or in part in a county with a population of 2.8 million or more. H.B. 1454 authorizes residents in counties with a population of 2.8 million or more, or a county with a population of 250,000 or more that is adjacent to a county with a population of 2.8 million or more and that is adjacent to the Gulf of Mexico, to amend the restrictions on residential real estate subdivisions. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 204.002(a), Property Code, to add a residential real estate subdivision, excluding a condominium development governed by Title 7, Property Code, that is located in whole or in part in a county with a population of 250,000 or more that is adjacent to a county having a population of 2.8 million or more and is adjacent to the Gulf of Mexico to the list of residential real estate subdivisions to which this chapter applies. SECTION 2. Effective date: September 1, 2003.
