H.B. 1454 78(R) BILL ANALYSIS H.B. 1454 By: Eiland Land & Resource Management Committee Report (Amended) BACKGROUND AND PURPOSE Many subdivisions along the Texas coast were created a long time ago. Some subdivision restrictions now need to be updated to include provisions for the collection of maintenance fees and for assessments in order to protect the shore and deal with storm damage. H.B. 1454 authorizes residents in counties with a population of 2.8 million or more, or a county with a population of 250,000 or more that is adjacent to a county with a population of 2.8 million or more to amend the restrictions on residential real estate subdivisions RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Amends Section 204.002(a), Property Code, to include within the Property Code chapter authorizing and providing for home owner's associations a new class of residential subdivisions (those that are located in a county with a population of 2.8 million or more, or a county with a population of 250,000 or more that is adjacent to a county having a population of 2.8 million or more and adjacent to the Gulf of Mexico). SECTION 2. Effective date. EFFECTIVE DATE September 1, 2003. EXPLANATION OF AMENDMENT SECTION 1.Adds bracket language to limit the application of this bill.
