SRC-LBB H.B. 1458 78(R) BILL ANALYSIS Senate Research Center H.B. 1458 78R5388 BDH-DBy: Eiland (Jackson) Criminal Justice 5/22/2003 Engrossed DIGEST AND PURPOSE Under current law, honorably retired peace officers are not specifically protected under the Obstruction or Retaliation Act (Penal Code 36.06), which sets the penalty for intentional harm to a public servant, witness, prospective witness, or informant at a second degree felony. H.B. 1458 includes honorably retired peace officers in this protected group. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 36.06(b), Penal Code, to define "honorably retired peace officer," and "public servant." SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2003.
