DIGEST AND PURPOSE 

Currently, a temporary liquor license holder can sell liquor outside the
county in which the permit is issued.  A temporary beer and wine license
holder, however, cannot.  H.B. 1625 extends the authority to sell beer or
wine outside the county in which a temporary beer and wine retailer permit
is issued. 

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the Texas Alcoholic Beverage
Commission in SECTION  2 (Section 27.011, Alcoholic Beverage Code) of this
bill. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 27.01, Alcoholic Beverage Code, to delete a
provision that a temporary wine and beer retailer's permit does not
authorize the sale of those beverages outside the county for which it is
issued. 

SECTION 2.  Amends Subchapter A, Chapter 27, Alcoholic Beverage Code, by
adding Section 27.011, as follows: 

Sec. 27.011.  SALE OUTSIDE PERMIT HOLDER'S COUNTY.  Requires a holder of a
temporary wine and beer retailer's permit that sells wine, beer, or malt
liquor under that permit in a county other than the county in which the
premises covered by the permit required by Section 27.04 is located to:
purchase the beverages from a distributor or wholesaler authorized under
this code to sell the beverages under this chapter; and report to the
Texas Alcoholic Beverage Commission (TABC), in the manner prescribed by
TABC rule, the amount of beverages purchased and sold under this section,
by type. 

SECTION  3.  Makes application of this Act prospective.

SECTION 4.  Effective date:  September 1, 2003.
