H.B. 1629 78(R) BILL ANALYSIS H.B. 1629 By: Keffer, Jim Public Health Committee Report (Unamended) BACKGROUND AND PURPOSE The 77th Legislature passed HB 3351, relating to the regulation of immediate precursors and certain other chemicals used in the illicit manufacture of a controlled substance; providing penalties. It was found through the prosecution of these cases that the language of HB 3351 is somewhat unclear. HB 1629 clarifies what substances are considered chemical precursors and what substances are not. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Amends Section 481.077(l), Health and Safety Code, to clarify what substances are exempted from this section. Amends Section 481.124, Health and Safety Code, to clarify what substances are affected by this section, including those named as a chemical precursor by the executive director of DPS. The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. EFFECTIVE DATE September 1, 2003.
