H.B. 1631 78(R) BILL ANALYSIS H.B. 1631 By: Hilderbran County Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE Kimble County Hospital District was authorized and created by Acts of the 62nd Legislature, Regular Session, 1971, by authority set out in the Texas Constitution. The hospital district was charged with the responsibility of establishing a hospital and hospital system within its boundaries and to furnish a hospital and medical care to the residents of the district. Since its creation the Kimble County Hospital District has served its residents well. However, the enabling legislation is binding and does not allow for updating. The current board of directors have requested changes to the enabling legislation to allow for broader operations. The purpose of this legislation is to change the terms of the board of directors from a two-year term to a three-year term, to allow the board to issue and sell bonds, and to give the board the authority to borrow money. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Section 1: Changes the term of a board member from two years to three years. Changes the election for board members from April to May. Section 2: Adds Section 11A to authorize the district to issue and sell revenue bonds in the name and faith and credit of the district. Section 3: Adds Section 12A to authorize the district authority to borrow money. Section 4: States the board of directors elections scheduled prior to the enactment of this act must be held and that the directors elected shall draw lots to determine two three year terms. Section 5: Sets the effective date of the legislation immediately if it received a two-thirds vote of all members elected members to each house. Otherwise, September 1, 2003.
