SRC-JEC H.B. 1686 78(R) BILL ANALYSIS Senate Research Center H.B. 1686 By: Chisum (Deuell) Health & Human Services 5/21/2003 Engrossed DIGEST AND PURPOSE Currently, institutions licensed under Chapter 242 or 252 of the Health and Safety Code must obtain emergency medication kits from pharmacies located within the state. The pharmacies physically maintain the kits for the institutions, and the controlled substances and dangerous drugs in an emergency medical kit used at such institutions may be used only for the emergency medication needs of a resident of that institution. H.B. 1686 allows a Class E pharmacy not more than 20 miles from an institution in Texas to maintain the emergency medication kits. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 562.108(a), Occupations Code, to authorize a Class E pharmacy located not more than 20 miles from an institution in this state that is licensed under Chapter 242 (Convalescent and Nursing Homes and Related Institutions) or 252 (Intermediate Care Facilities for the Mentally Retarded), Health and Safety Code, to maintain controlled substances and dangerous drugs in an emergency medication kit used at an institution licensed under those chapters. Prohibits a Class E pharmacy from maintaining drugs in an emergency medication kit for an institution that is located more than 20 miles from the pharmacy. SECTION 2. Effective date: upon passage or September 1, 2003.
