H.B. 1702 applies Section 263.053, Local Government Code, to counties with a population of more than 250,000, rather than 500,000, which includes eight more Texas counties (Collin, Denton, Fort Bend, Cameron, Nueces, Montgomery, Jefferson, and Galveston). RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends the heading to Section 263.053, Local Government Code, to read as follows: Sec. 263.053. SALE AND SUBSEQUENT LEASE OF PROPERTY IN COUNTIES WITH POPULATION OF MORE THAN 250,000. SECTION 2. Amends Section 263.053(a), Local Government Code, to provide that this section applies only to counties with a population of more than 250,000, rather than 500,000. SECTION 3. Effective date: upon passage or September 1, 2003. LIST OF COMMITTEE AMENDMENTS Committee Amendment No 1: Section 263.053, Local Government Code, is amended to read as follows: SECTION 263.053. SALE AND SUBSEQUENT LEASE OR LICENSE OF PROPERTY IN COUNTIES WITH POPULATION OF MORE THAN 250,000 [500,000]. (a) "This section applies only to counties with a population of more than 250,000 [500,000]." (b) "The commissioner court of the county may enter into any for-profit or other licensing agreement with a seller of wireless communications service that may include a license to collocate wireless communications technology on property owned by the county."
