SRC-AMY H.B. 1733 78(R) BILL ANALYSIS Senate Research Center H.B. 1733 78R7440 MTB-FBy: Hamric (Shapiro) Infrastructure Development and Security 5/16/2003 Engrossed DIGEST AND PURPOSE Currently, state law requires persons weighing cargo to keep a written record of the vehicles weighed for 180 days. The number of vehicles weight enforcement officers routinely weigh, makes keeping a weight record on every vehicle weighed time consuming and costly. H.B. 1733 exempts a vehicle that transports solid waste, is weighed by a weight enforcement officer, or is weighed on scales owned by the state, or a political subdivision thereof, from the responsibility of having to maintain a written weight record. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 621.410(e), Transportation Code, to establish that this section does not apply to a vehicle that transports material regulated under Section 623.161 (Definition), is weighed by a weight enforcement officer, or is weighed on scales owned by the state or a political subdivision thereof. SECTION 2. Effective date: upon passage or September 1, 2003.
