H.B. 1733 78(R) BILL ANALYSIS H.B. 1733 By: Hamric Transportation Committee Report (Unamended) BACKGROUND AND PURPOSE House Bill 1733 exempts the state or a political subdivision of the state from the responsibility of having to maintain a written weight record of each vehicle weighed. The 77th Legislature passed Senate Bill 220 requiring persons weighing cargo to keep for 180 days a written record of the vehicles weighed. Due to the number of vehicles weight enforcement officers routinely weigh, keeping a weight record on every vehicle weighed is time consuming, costly, and of no direct benefit to the state. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS HB 1733 amends Section 621.410(e), Transportation Code, as follows: Section 621.410(e):excludes weight enforcement officers and vehicles weighed on scales owned by the state or a political subdivision of the state from having to keep a written record of vehicles weighed. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the act takes effect September 1, 2003.
