DIGEST AND PURPOSE 

Currently, state law requires persons weighing cargo to keep a written
record of the vehicles weighed for 180 days.  The number of vehicles
weight enforcement officers routinely weigh, makes keeping a weight record
on every vehicle weighed time consuming and costly. C.S.H.B. 1733 exempts
a vehicle that transports solid waste, is weighed by a weight enforcement
officer, is weighed on scales owned by the state, or a political
subdivision thereof, or is weighed on scales owned by an enterprise
principally engaged in the retail sale of motor fuels to the general
public, from the responsibility of having to maintain a written weight
record. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 621.410(e), Transportation Code, to establish
that this section does not apply to a vehicle that transports material
regulated under Section 623.161 (Definition), is weighed by a weight
enforcement officer, or is weighed on scales owned by the state or a
political subdivision thereof, or is weighed on scales owned by an
enterprise principally engaged in the retail sale of motor fuels to the
general public.. 

SECTION 2.  Effective date:  upon passage or September 1, 2003.
