SRC-TJG H.B. 1872 78(R) BILL ANALYSIS Senate Research Center H.B. 1872 78R7736 KCR-DBy: Riddle (Williams) Criminal Justice 5/22/2003 Engrossed DIGEST AND PURPOSE Under current law, vehicles are not included in the list of places onto or into which trespassing is punishable. People have been known to break into vehicles, not with the intent to steal, but to us as shelter. H.B. 1872 adds vehicles to the list of places where trespassing is prohibited. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 30.05(a), Penal Code, to provide that a person commits an offense if he enters or remains on or in property, including an aircraft or other vehicle, of another without effective consent or he enters or remains in a building of another without effective consent and he had notice that the entry was forbidden or received notice to depart but failed to do so. SECTION 2. (a) Effective date: September 1, 2003. (b) Makes application of this Act prospective.
