H.B. 1872 78(R) BILL ANALYSIS H.B. 1872 By: Riddle Criminal Jurisprudence Committee Report (Unamended) BACKGROUND AND PURPOSE Under current law, vehicles are not included in the list of punishable trespass violations. People have been known to break-in to vehicles, not with the intent to steal, but to sleep inside the vehicle. House Bill 1872 includes vehicles to the list of places where trespassing is prohibited. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1872 amends the Penal Code to state that a person commits a trespass offense if he enters or remains on or in property, including an aircraft or other vehicle, without consent or after receiving notice to vacate. EFFECTIVE DATE September 1, 2003.
