SRC-AMY H.B. 1883 78(R) BILL ANALYSIS Senate Research Center H.B. 1883 By: Baxter (Ogden) Infrastructure Development and Security 4/22/2003 Engrossed DIGEST AND PURPOSE Currently, there is no statutory authority for a member serving on a metropolitan planning organization to appoint a proxy to act in the member's absence on matters before the policy board. H.B. 1883 authorizes a policy board of a metropolitan planning organization to provide for appointing voting proxies by its members, and establishes related requirements. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 472, Transportation Code, by adding Subchapter D, as follows: SUBCHAPTER D. METROPOLITAN PLANNING ORGANIZATIONS Sec. 472.031. POLICY BOARD. (a) Authorizes a policy board of a metropolitan planning organization, designated or redesignated under 23 U.S.C. Section 134, to provide in its bylaws for appointment of voting proxies by its members. (b) Sets forth requirements regarding the appointed proxy. (c) Provides that this section applies only to a policy board with at least 22 voting members of a metropolitan planning organization designated or redesignated for an urbanized area that meets certain criteria. SECTION 2. Effective date: upon passage or September 1, 2003.
