BACKGROUND AND PURPOSE 

Under Section 110.002 of the Family Code, a $15 filing fee is established
for several court filings. The list of filings does not include motions
for modification or motions for contempt.  H.B. 1885 provides that clerks
are authorized to collect a $15 filing fee for a motion for modification
or a motion for contempt. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 110.002(a), Family Code, to authorize the clerk
of the court to collect a filing fee of $15 in a suit for filing a motion
for modification or a motion for contempt. 

SECTION 2.(a)  Effective date: September 1, 2003.

  (b)  Makes application of this Act prospective.
