H.B. 1885 78(R) BILL ANALYSIS H.B. 1885 By: Goolsby Juvenile Justice & Family Issues Committee Report (Unamended) BACKGROUND AND PURPOSE Under Section 110.002, of the Family Code a $15 filing fee is established for several court filings. The list of filings does not include motions for modification or motions for contempt. House Bill 1885 would add language to clarify that a $15 filing fee is required of motions for modification and motions for contempt filed under the Family Code. House Bill 1885 would clarify that clerks are authorized to collect a $15 filing fee for motions for modification and motions for contempt. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 110.002(a), Family Code, that provides that the clerk of the court may collect a filing fee of $15 in a suit for filing motions for modification and motions for contempt to the filing fee list. SECTION 2.This Act takes effect September 1, 2003. Prospective provisions. EFFECTIVE DATE September 1, 2003.
