H.B. 1931 78(R) BILL ANALYSIS H.B. 1931 By: Capelo Energy Resources Committee Report (Unamended) BACKGROUND AND PURPOSE The current statute of Chapter 81.056 Natural Resources Code was passed into law during the 77th Legislative Session in reaction to the Longhorn Pipe Line Project in Austin. The current provision requires at least 30 days notice and an opportunity for public comment before a pipeline project can be built, if that pipeline crosses more than three counties. The Railroad Commission cannot issue the permit until said comments have been considered. House Bill 1931 repeals the existing provisions of Chapter 81.056 of the Natural Resources Code. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS SECTION 1. Repeals the existing provisions of Ch. 81.056 Natural Resources Code. SECTION 2. The bill only affects pipeline permits which are pending on the effective date of the bill or is filed with the Railroad Commission on or after that date. SECTION 3. The bill provides for an immediate effective date if it receives two-thirds of the vote of both houses. EFFECTIVE DATE This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
