C.S.H.B. 1998 78(R) BILL ANALYSIS C.S.H.B. 1998 By: Gutierrez Licensing & Administrative Procedures Committee Report (Substituted) BACKGROUND AND PURPOSE The Texas Alcoholic Beverage Commission (TABC) was established in 1935 as the state regulatory agency covering all phases of the alcoholic beverage industry in the State of Texas. The duties of the Commission include regulating sales, taxation, importation, manufacturing, transporting, and advertising of alcoholic beverages. The daily activities are governed by an administrator, unlike common practice at other state agencies which refers to such a title as executive director. By definition, an executive director manages the affairs of the department under the direction of the governing board. In contrast, an administrator is one to assist an executive or a department head of staff with administrative duties for the agency or a particular division of a department. This bill would change the titles of the heads of the staff of the Texas Alcoholic Beverage Commission to executive director and deputy executive director. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS Amends Section 5.11, Alcoholic Beverage Code by changing "administrator" title to "executive director." Any reference to this code in other law to the administrator of the commission means the executive director. Amends Section 5.13, Alcoholic Beverage Code by changing "assistant administrator" to "deputy executive director." EFFECTIVE DATE September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE CSHB 1998 modifies the original by changing the title in Section 5.13, Alcoholic Beverage Code to replace "assistant" executive director to "deputy" executive director. The substitute makes the same changes throughout the bill.
