H.B. 2013 78(R) BILL ANALYSIS H.B. 2013 By: Quintanilla Public Education Committee Report (Unamended) BACKGROUND Currently in certain regions of Texas, students from outside the state are enrolling in Texas public schools separate and apart from the their parents or guardian. This has resulted in a substantial financial burden for these select Texas school districts. Under current law, the board of trustees lacks jurisdiction to deny admission to a person's presence in the district if it is primarily for the purpose of avoiding enrollment in a school district outside of this state. PURPOSE The purpose of House Bill 2013 is to provide a board of trustees the flexibility and authority to deny a person's admission if they find the person's sole purpose is to avoid enrollment in a school outside of this state. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. ANALYSIS House Bill 2013 amends the Education Code to provide that a board of trustees is not required to admit to a school district a person whose presence in the district is primarily for the purpose of avoiding enrollment in a school district outside of this state. This Act applies beginning with the 2003-2004 school year. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003.
