SRC-AMY H.B. 2033 78(R) BILL ANALYSIS Senate Research Center H.B. 2033 By: Menendez (Fraser) Business & Commerce 5/16/2003 Engrossed DIGEST AND PURPOSE The Texas Building and Procurement Commission is required to develop an annual report of contracts awarded to historically underutilized businesses (HUBs) and state agencies are required to establish goals to increase contracting with HUBs. However, many agencies treat investment brokerage services as "professional services" rather than as "contract services," and do not include such services for purposes of HUB reporting. Consequently, the goals for HUB procurement often do not include the services of HUB brokerage vendors, which could result in fewer brokerage contracts being awarded to HUB vendors. H.B. 2033 sets forth a definition of "contract" as including an arrangement under which a state agency receives professional or investment brokerage services. This bill also provides that including the definition is for the purpose of aiding in the measurement and attainment of a state agency's goals. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2161.001, Government Code, by adding Subdivision (4) to define "contract" to include an arrangement under which a state agency receives professional or investment brokerage services. SECTION 2. Provides that the definition in Section 2161.001(4), Government Code, as added by this Act, is for the purpose of aiding in the measurement and attainment of a state agency's goals. SECTION 3. Effective date: September 1, 2003.
