DIGEST AND PURPOSE 


Under current law, if a disciplinary action is being taken against a
student who is transferring from a charter school to a public school, the
charter school is not required to send a copy of the student's order of
disciplinary action to the public school.  As a result, a public school's
administration is unaware of the student transferee's disciplinary
problems.  However, a copy of the order of disciplinary action is required
when a student is transferring between two public schools. H.B. 2061
requires a charter school to send a transferring student's order of
disciplinary action to the enrolling school, just as public schools are
required to do. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 37, Education Code, by adding
Section 37.021, as follows: 

Sec.  37.021.  NOTICE OF DISCIPLINARY ACTION.  (a)  Defines "disciplinary
action" and "district or school."  

(b)  Requires the governing body of the district or school taking the
disciplinary action to provide to the district or school in which the
student enrolls, at the same time other records of the student are
provided, a copy of the order of disciplinary action, if  a district or
school takes disciplinary action against a student and the student
subsequently enrolls in another district or school before the expiration
of the period of disciplinary action. 

(c)  Authorizes the district or school in which the student enrolls to
continue the disciplinary action under the terms of the order or to allow
the student to attend regular classes without completing the period of
disciplinary action, subject to Section 37.007(e). 

SECTION 2.  Repealer: Section 37.008(j), Education Code (regarding
alternative education programs). 

SECTION 3.  Provides that this Act applies beginning with the 2003-2004
school year. 

SECTION 4.  Effective date: upon passage or September 1, 2003.
