C.S.H.B. 2072 78(R) BILL ANALYSIS C.S.H.B. 2072 By: Grusendorf Public Education Committee Report (Substituted) BACKGROUND Until 1995, if a teacher could not account for a textbook, they could be held financially liable. While this provision was eliminated in 1995, some school districts continue to hold teachers financially accountable for textbooks lost or stolen by students. PURPOSE The purpose of C.S.H.B. 2072 is to clarify that a teacher is not required to pay for a textbook that is stolen, misplaced, or not returned by a student. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 2072 amends the Education Code to prohibit the board of trustees of a school district from requiring a district employee to pay for a textbook that is stolen, misplaced, or not returned by a student. This Act applies beginning with the 2003-2004 school year. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 2072 modifies the original version by conforming to the Legislative Council style and format.
