While this provision was eliminated in 1995, some school districts continue to hold teachers financially accountable for textbooks lost or stolen by students. H.B. 2072 prohibits the board of trustees of a school district from requiring an employee of the district to pay for a textbook that is stolen, misplaced, or not returned by a student. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 31.104, Education Code, by adding Subsection (e) to prohibit the board of trustees of a school district from requiring an employee of the district to pay for a textbook that is stolen, misplaced, or not returned by a student. SECTION 2. Provides that Section 31.104(e), Education Code, as added by this Act, applies beginning with the 2003-2004 school year. SECTION 3. Effective date: upon passage or September 1, 2003.
