DIGEST AND PURPOSE 

Current law prescribes different electioneering and distance markers for
the general election day and the early voting period.  Polling place and
campaign workers are required to know different rules for different
elections.  H.B. 2093 prohibits a person from electioneering in or within
100 feet of an outside door through which a voter may enter the building
or structure in which the early voting polling place is located. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to
a state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Sections 85.036(a) and (d), Election Code, as follows:

(a)  Prohibits a person from electioneering for or against any candidate,
measure, or political party in or within 100 feet of an outside door
through which a voter may enter, rather than a certain distance from, the
building or structure in which the early voting polling place is located
during the time an early voting polling place is open for the conduct of
early voting.  Removes exception as provided by Subsection (b).  Deletes
language relating to previous rules for posting distance markers.   

(d)  Provides that a person commits an offense if the person electioneers
in violation of Subsection (a).  Makes a conforming change. 

SECTION 2.  Repealer:  Sections 85.036(b) and (f) (Electioneering
Prohibited), Election Code. 

SECTION 3.  Effective date:  September 1, 2003.
