DIGEST AND PURPOSE 

Currently, there are no restrictions preventing multiple affordable
housing developments within the same neighborhood.  H.B. 2308 requires the
Texas Department of Housing and Community Affairs to develop rules to
regulate the concentration of affordable housing receiving low income
housing tax credits.  

RULEMAKING AUTHORITY

Rulemaking authority is expressly granted to the Texas Department of
Housing and Community Affairs in SECTION 1 (Section 2306.67035, Government
Code) of this bill.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter DD, Chapter 2306, Government Code, by adding
Section 2306.67035, as follows: 
 
Sec. 2306.67035.  REGULATION OF LOCATION OF CERTAIN DEVELOPMENTS. (a)
Requires the Texas Department of Housing and Community Affairs (TDHCA) by
rule to develop appropriate guidelines under the low income housing tax
credit program in which the applicant proposes to construct a new
development that is located one linear mile or less from a certain
development. 

(b)  Requires a rule adopted by TDHCA under Subsection (a) to exempt a
certain development. 
  
SECTION 2.  Effective date:  September 1, 2003.
