BACKGROUND AND PURPOSE 
Currently, The Texas Department of Health cannot prevent adulterated or
misbranded products from reaching consumers and is unable to take action
when violations of the law occur and voluntary corrective action is
ineffective.  This bill will establish enforcement tools for manufacturers
and distributors of frozen desserts (Health and Safety Code, Chapter 440)
that will protect consumers 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution. 

ANALYSIS

The bill amends the Health and Safety Code by including frozen dessert
products and manufacturers in regulations under Chapter 431, Health and
Safety Code. In addition the bill provides that a person holding a license
under chapter 440 is not required to hold a license as a food manufacture
or food wholesaler under subchapter J or subchapter A.  

The TDH commissioner may refuse to grant a license, or may suspend or
revoke a license issued under Chapter 440, Health and Safety Code. 


EFFECTIVE DATE

September 1, 2003.
