C.S.H.B. 2384 78(R) BILL ANALYSIS C.S.H.B. 2384 By: Hegar Transportation Committee Report (Substituted) BACKGROUND AND PURPOSE Subchapter D of the Transportation Code allows a county to establish an administrative procedure to enforce collection of tolls by toll violators that use "EZ Tags." By establishing an administrative procedure, the county does not have to go through the traditional criminal court procedures, which is costly and inefficient when considering how comparatively little the County is likely to recover. Currently, the Subchapter D, Chapter 284, Transportation Code, only applies to Harris County. This legislation would apply Subchapter D to Harris County and all counties adjacent to Harris County. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2384 amends Section 284.201 of the Transportation Code to include counties that are adjacent to counties with populations greater than 3.3 million. EFFECTIVE DATE Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute differs from the original in that the substitute is a Legislative Council draft.
